Article 1 — Purpose

This Data Protection Notice has been prepared by AYKACH WATCH - ERSER SAATÇİLİK KUYUMCULUK İLETİŞİM İTHALAT İHRACAT SAN. VE TİC. LTD. ŞTİ. (the "Company"), acting as data controller within the scope of the Law on the Protection of Personal Data No. 6698 ("KVKK"), to explain the procedures and principles governing the processing of personal data of individuals (the "Data Subject") who visit and/or use www.aykach.com.

Article 2 — Personal Data Collected

2.1. The Company collects personal data in the following categories:

a) Identity Data: First name, surname.
b) Contact Data: Email address, phone number, delivery and billing address.
c) Customer Transaction Data: Order details, purchase history, return and complaint records.
d) Financial Data: Payment method information (card details are not stored directly by the Company; they are processed through payment infrastructure providers).
e) Digital Footprint Data: IP address, cookie data, browser type, visit time and page interactions.
f) Marketing Data: Newsletter subscription and campaign preferences, where explicit consent has been obtained.

Article 3 — Purposes of Processing Personal Data

3.1. The collected personal data is processed for the following purposes:

a) Managing order processes and fulfilling deliveries.
b) Meeting contractual obligations.
c) Providing customer services and handling complaints.
d) Fulfilling legal obligations and reporting to authorised bodies.

Article 4 — Legal Basis for Processing Personal Data

4.1. Your personal data is processed on the following legal grounds as set out in Articles 5 and 6 of the KVKK:

Article 5 — Transfer of Personal Data

b) Payment infrastructure providers (for ensuring payment security).
c) Information technology and infrastructure service providers.
d) Authorised public institutions and organisations where legally required.

5.2. Transfer of data abroad may be carried out within the scope of Article 9 of the KVKK, provided that the necessary safeguards are in place.

Article 6 — Retention Period of Personal Data

6.1. Your personal data is retained for as long as required by the purpose for which it is processed. Subject to any statutory retention obligations, your personal data is deleted, destroyed, or anonymised once the purpose has been fulfilled.

6.2. Order and invoice information is retained for 10 (ten) years in accordance with the Turkish Commercial Code and the Tax Procedure Law.

f) To request the deletion or destruction of your personal data within the scope of Article 7 of the KVKK.
g) To request that the above transactions be notified to third parties to whom your personal data has been transferred.
h) To object to any outcome arising solely from the automated analysis of processed data that is detrimental to you.
i) To claim compensation for any damages suffered as a result of unlawful processing of your personal data.

Article 9 — How to Submit a Request

9.2. Your requests will be concluded within 30 (thirty) days from the date of receipt. In the event that your request is rejected, the response is deemed insufficient, or no response is provided within the applicable period, you retain the right to lodge a complaint with the Personal Data Protection Authority (KVKK).
